integrated statistical systems ferociously attack - 'Disabled.' Contemporary computer software programs are
hardwired to always point to and seek out the term 'Disabled.' If computers had a personality disorder we would
best describe it as sociopathic and its biggest enemy would be the term 'disabled'. Maybe we should go back to
the sporting term of fairness, 'handicapped'. Do you recall the story of the "Tortoise and the Hare ?" I guess it all
depends if google has digitalized it or if wikipedia demoralized the theme - the tortoise was game and won the

Americans have problems that require a letter to the president to straighten out an issue, especially if the issue already has a
process and function in place to handle such concerns as disability discrimination and retaliation in higher education - a direct
causal effect of a health care system gone astray.
Unfortunately, after two years of writing reports to the Justice Department at the request of the Justice Department, I just received
what is known in disable student circles as a 'Cee Cee Rubber Stamp" letter that states "The circumstances you describe do not
raise an issue that we are able to address," signed Cee Cee Allaway, Director, Complaint Intake & Adjudication. My concerns list in
details, the systematic discrimination that exist today on American Campuses that played a major role in the shooting at Virginia
Tech, on one of your campuses, Illinois University in April 2008, and a library in my own Home town of San Antonio Texas less than
six months ago!
Senator John Cornyn is monitoring this case because I made a commitment to his office, "If this case is investigated thoroughly it
will help all Texas Disabled students." I also made a commitment to the Dallas Office of Civil Rights that I would cooperate fully with
the investigation that is now in process for over two years and is a major campus safety concern. The Dallas Field Office of Civil
Rights can not perform their duties if Cee Cee rubber stamps and rejects valid complaints from students and also in this case
disabled student parents of students that attend Texas Campuses- We have a valid interest in this case regardless of the fact that
we are both disabled.
Lastly, at the request of the Justice Department, I have submitted 100rds of pages of testimony that is still under investigation by the
Dallas Field Office. Today, I receive a letter from Cee Cee Allaway that does not state which of the 27 separate grievances of
discrimination, retaliation, and harassment now under investigation by the Dallas Field Office that Cee Cee is rejecting. Please
have your staff look into the bogus investigations by the Justice Department over the last eight years during the Bush Administration.
Due process can not work with a Justice Department that cheats to its own agenda.

This public statement on the Gov Reg. page means all students with disabilities will be targeted by unofficial staff breaches. Please
reconsider the proposed clarification rules in reference to the Family Educational Rights and Privacy Act as it relates to the disabled
student population at colleges and universities in Texas and across America. There are two agendas promoted by the consortium of
higher education known as NCHERM with memberships greater than 500 colleges and university across America: 1. Campus Violence
2. Financial liability. These issues must be addressed separately or dire consequences will result from the push to reduce financial risk
by deregulation of privacy laws under the guise to end violent acts on campus. Disabled students may have already been targeted as
liability risk by the same law enforcement tool used to identify disturbed students in order to prevent
occurrences such as the “tragic events at Virginia Tech in April 2007.”
The behavior assessment system CUBAS, incorporated on every campus to end violence would benefit most from the purposed
deregulation. The privacy rule changes specifically relating to campus safety should go forward immediately. Using the 911 Patriot Act to
deregulate privacy laws for campus safety, is a necessary evil, an irritation of privacy for the better good and protection of students.
Unfortunately, the medical records of stable students identified on campus disabilities rosters may already been targeted for
compromise by “unauthorized access by school officials” solely for financial risk management. The disabled student population is the
only minority group segregated and identified on official state rosters and therefore subjects of discrimination by the purposed regulation.
The areas of comprise are not limited to, Misrepresentation of Medical records, Mistreatment of the disabled third party business, Denied
Access to programs, Reduction in financial aid, Harassment by misguided faculty and staff, Discrimination by campus police, Medical
breaches under the guise of academic research.
Could it be that some of the most recent campus unrest could be contributed to mandatory state and university staff instructions which do
not address ways to stop or reduce discrimination/ harassment but identifies any student with a legidement ADA disability grievance as
a dangerous violent threat? NCHERM is promoting web training in the same context of campus violence and repeatedly uses the same
push used as background information by the Department of Education for privacy deregulation; Background “… in light of the tragic events
at Virginia Tech in April 2007.” NCHERM promotional ad seems to mix the Virginia Tech tragedy in context of ADA grievances filed by sane

A woman opened fire during a
biology faculty meeting at the
University of Alabama's Huntsville
campus Friday, killing three people
and injuring three others, officials
said. The shooter was caught
outside the Shelby Center, a science
building, without incident, according
to university spokesman Ray Garner.
Local media reported the shooter
was a faculty member, though Garner
said he could not identify her. A man
was also being detained.
